The Cold Bear Plunge LLC Refund Policy (‘Refund Policy’) is offered to customers who purchase Cold Bear Plunge products directly from our company. This is applicable to the specific Cold Bear Plunge products ensures that they are free of defects in both materials and workmanship, granted they are used in accordance with the published guidelines during the specified warranty periods.

We offer a 14-day return policy if you are dissatisfied for any reason.

To be eligible for a return, your item must meet the following criteria:

• In the same condition as received.
• Unworn or unused.
• Accompanied by the receipt or proof of purchase.

Place the product back in its original packaging and box.

For freight-shipped items, securely place the packaged product on the original pallet it arrived with.

The customer is responsible for covering the shipping costs for returning any item. These costs are non-refundable. If a refund is issued, the cost of return shipping will be deducted from the refund.

Cold Bear Plunge, LLC. (“Cold Bear Plunge”) guarantees to the original consumer purchaser that the products and component parts are free of material and workmanship defects within the specified period below.

• 1-Year Shell Structure - Your Cold Bear Plunge is warranted against water loss due to defects in the spa shell, blisters, cracks, or delamination of the interior surface of the spa shell due to defects in workmanship or materials for one year from the original date of purchase.
• 1-Year Equipment and Controls – Specifically the pumps, heater, and control system – are warranted against malfunctions due to defects in workmanship or materials for one year from the original date of purchase.
• 1-Year Plumbing Components - Cold Bear Plunge plumbing components are warranted against leaks due to defects in workmanship or materials for one year from the original date of purchase.

The factory installed Cold Bear Plunge Water Purification system is warranted against malfunction due to defects in workmanship or materials for one year from the original date of purchase. All other factory installed components not mentioned specifically, including, but not limited to the frame, jets, diverter valves, Lighting systems, filter shield, filter lid, and mechanical components are warranted against malfunction due to defects in workmanship or materials for one year from the original date of purchase.

This Limited Warranty is void if Cold Bear Plunge or its designated representative determines that the spa has been subjected to damage or failure due to installation of aftermarket parts that are not genuine Cold Bear Plunge branded Parts & Accessories. This disclaimer includes, but is not limited to filters, UV-C bulbs, ozone systems, repair parts and other accessories. Genuine  brand Parts & Accessories are built to our highest standards of quality, durability and performance, and they are designed to work with your Cold Bear Plunge to ensure optimal performance and function.

WHAT WE WILL DO
At its own discretion, Cold Bear Plunge shall provide free repair or replacement of any defective product or component that has been installed, used, and serviced normally, within the specified warranty period.  In the event that repair or replacement is not feasible, Cold Bear Plunge may at it's sole discretion, choose to reimburse the purchase price in exchange for the return of the product.  Please note that replacement parts may not be identical to the original ones, and their availability is always subject to change. These remedies are the only options available to you.

WHAT YOU MUST DO

To make a warranty claim for a product, you need to contact the retailer or distributor from whom you purchased it, accompanied by the original sales receipt as proof of purchase and a written description of the defect. If you purchased the product directly from the Cold Bear Plunge website, you can reach out to us online. Please ensure to include your order number and purchase date while contacting us.  Please email warranty@coldbearplunge.com.

To obtain service in the event of a defect covered by this Limited Warranty, reach out as soon as possible and use all reasonable means to protect the spa from further damage. Upon proof of purchase, a designated service representative will correct the defect subject to the terms and conditions contained in this Limited Warranty. There will be no charge for parts or labor to repair the defect, although providing access to affect the repair is your responsibility as the owner of your Cold Bear Plunge System.

You may be assessed reasonable repairman travel mileage charges. In the event that the spa is removed to a repair facility for repair and reinstalled, the cost of removal and reinstallation will be your responsibility as the Cold Bear Plunge owner. The Manufacturer or distributor reserves the right, at its sole option, to either repair or replace any covered part, and in the event it chooses to provide a replacement Cold Bear Plunge, it will be of equal value to the original. In such an event, reasonable costs for removal of the original Cold Bear Plunge, including shipping costs from the factory for the replacement Cold Bear Plunge and delivery and installation of the replacement will be your responsibility as the owner. The replacement Cold Bear Plunge will carry the balance of the original warranty as described above. Spa covers are not included.

WARRANTY LIMITATIONS
This Residential Limited Warranty is void if: Used in a commercial setting, the Manufacturer or its designated representative determines that the spa has been subjected to alteration, neglect, misuse or abuse, or freight damage caused by the common carrier; any repairs have been attempted by anyone other than a designated representative; or if the failure is caused by accident, acts of God or other causes beyond the control of the Manufacturer.  Neglect, misuse and abuse include any installation, operation or maintenance of the Cold Bear Plunge other than in accordance with the instructions contained in the owner’s manual provided with the Cold Bear Plunge, including but not limited to the failure to maintain proper water chemistry and chemical balance.  Any use of abrasive or improper cleaners or non-genuine parts and accessories shall make this Limited Warranty null and void.

This Limited Warranty does not provide coverage for the insulating cover, any item attached to or installed on the Cold Bear Plunge after the date of manufacture, or for gaining access to any component for repair or replacement. Systems used in commercial applications are excluded from any coverage whatsoever.

The Cold Bear Plunge owner accepts any and all liability for repair work performed by anyone other than the Manufacturer or a designated Cold Bear Plunge representative. Cold Bear Plunge is not responsible for work performed on any units outside of the United States.

LIMITATIONS ON IMPLIED WARRANTIES

This Limited Warranty takes the place of all other warranties, express or implied, in fact or at law. All warranty service must be performed by the Manufacturer or its designated representative using authorized Cold Bear Plunge parts. No agent, dealer, distributor,
service company or other party is authorized to change, modify or extend the terms of this limited warranty in any manner whatsoever. The Manufacturer will not be responsible for any statements or representations made in any form that go beyond, are broader than, or are inconsistent with any authorized literature or specifications furnished by Cold Bear Plunge.

DISCLAIMERS
The MANUFACTURER AND ITS REPRESENTATIVES WILL NOT BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, and shall not be liable for any injury, loss, cost or other damage, whether incidental or consequential, arising out of any defect covered by this limited warranty, including without limitation, loss of use of the Cold Bear Plunge and cost for removal of defective product even if the Manufacturer was advised of the possibility of damage, and water damage. The liability of the Manufacturer under this limited warranty, if any, shall not exceed the original amount paid for the defective product.

Coverage under this limited warranty shall commence as of the original date of purchase and the duration of such coverage shall not extend for any reason whatsoever beyond the stated time periods. These disclaimers shall be equally applicable to any service provided by the Manufacturer and its designated representatives.

LEGAL RIGHTS
This Limited Warranty gives you specific legal rights. There are no warranties applicable to Cold Bear Plunge products except as expressly stated herein or as implied by applicable state and federal laws. You may also have other rights that vary from state to state. Some states do not allow limitations on how long an implied warranty lasts, disclaimer of certain warranties, or the exclusion or limitation of incidental or consequential damages so some of the above limitations.

Cancellation Policy
Some items in our store may be offered to you as a subscription, a pre-order or try before you buy. This cancellation policy lays out how you can change or cancel these kinds of purchases.

Subscriptions
When you purchase a subscription you'll receive repeat deliveries. These are based on the subscription duration and frequency that you select.

Your payment details will be stored securely and you'll be charged for each of these deliveries, unless you choose to pay in advance.

Some subscriptions may auto-renew at the end of their duration. If you don't want to renew a subscription you can cancel it.

Pre-orders

Try before you buy
If any of our products and services are offered by Cold Bear Plunge as a try before you buy; when you purchase a try before you buy item, we authorize your payment method before fulfilling the order. You will have 14 days from receipt of deliver, to decide if you want to keep the item.  Once the time period has passed, if you have not returned the item, we will charge your payment method for the full amount.

At Cold Bear Plunge, we understand the importance of a hassle-free delivery experience. That's why we offer two distinct shipping methods within the mainland USA to cater to your preferences.

For those who appreciate cost-effective and efficient delivery, we provide Standard Curbside Delivery at no additional charge.

1. UPS will reach out to schedule a delivery time via text or email
2. Your Cold Bear Plunge will be delivered directly to your curb or driveway.
3. Please note that with curbside delivery, UPS won't enter your home, assist with setup, or remove packing material or other refuse. 

For an upgraded delivery experience, we recommend our Premium In-Home Delivery service. This service is available as an optional upgrade when you buy a Cold Bear Plunge.

1. UPS will reach out to schedule a delivery time via text and email.
2. With premium placement delivery, UPS's expert team will carefully place your Cold Bear Plunge anywhere in your home, including up to ONE flights of stairs.
3. They will also handle the disposal of packaging materials.
4. It's essential to remember that UPS WON'T set up your Cold Bear Plunge to ensure it's assembled correctly and avoids any potential damage.

Once your Cold Bear Plunge is delivered and placed, setup typically takes around 20-30 minutes.  We are available for a video conference call should you need our help in the set-up process.

Shipping Fees for Specific U.S Territories, Alaska, Canada, Mexico & Puerto Rico:
For shipping to Hawaii, Puerto Rico, Alaska, Mexico and other U.S. territories, a shipping fee will apply upon the final purchasing process.

International Shipping:
International Shipping is available and shipping fees vary by country.

Order Processing:
Please refer to the product page for the order processing timeline.
You will receive an email confirmation with tracking information when your order is shipped.

Shipping Methods and Carriers:
Cold Bear Plunge exclusively ships through UPS for all orders in the U.S. and Canada.
Add-on accessories are shipped with the main order, unless purchased separately. If purchased separately, they will be shipped via FedEx, UPS, or USPS.  Cold Bear reserves the right to use whatever service is most convenient.

Delivery Locations:
Residential Homes: Packages will be delivered at the property entrance.
Apartments: Packages will be delivered to the shipping room or to the unit entrance.
Commercial Addresses: Packages will be delivered to the property entrance.  Once delivered, Cold Bear Plunge is not responsible and shall be held harmless from any claim or demand, including reasonable attorneys’ fees, If lost or stolen.

Before Your Delivery:
To ensure a smooth delivery process, please prepare the space where you want your product to be installed.

Shipping Delays:
While we strive for timely deliveries, please be aware that shipping delays may occur due to unforeseen circumstances or issues beyond our control. Your understanding is appreciated in such situations.
